CACC Disability Accommodations & Accessible Learning Service Policy

PURPOSE

Canadian All Care College (“CACC”) is committed to provide equal access, inclusion, and supporting individuals with disabilities who are academically qualified. The College will make necessary arrangements to provide reasonable accommodation and learning opportunities to students with mental, sensory, or cognitive disabilities.

SCOPE

This Policy applies to all students, employees, and participants affiliated with CACC. CACC and its staff are committed to accommodating those students’ needs regarding class attendance, assignment and examination submission.

DEFINITIONS

  1. Accessibility and Inclusivity are educational practices, systems, and support services designed to accommodate functional challenges due to a disability. CACC is committed to creating a learning environment that promotes full participation of individuals with disability. Examples include tutorial services, adaptive technologies, exam modifications (additional time, reduced distraction settings, or oral exams)
  2. Documentation refers to information obtained from a qualified professional whose credentials are approved by the regulatory bodies.
  3. Documented Disability means permanent or temporary physical, sensory, psychiatric, or learning disabilities that may hinder a student’s ability to perform the expected activities in an educational or field placement setting.
  4. Disability, as determined by the Ontario Human Rights Code, does not list all the conditions that may be considered a disability. However, the Ontario Human Rights Commission follows specific guidelines to help determine whether a condition is regarded as a disability under the Human Rights Code:
    • Any degree of physical disability, infirmity, malformation, or disfigurement that is caused by bodily injury, congenital disability, or illness and, without limiting the generality of the preceding, includes diabetes mellitus, epilepsy, a brain injury, any degree of paralysis, amputation, lack of physical coordination, blindness or visual impediment, deafness or hearing impediment, muteness or speech impediment, or physical reliance on a guide dog or other animal or a wheelchair or other remedial appliance or device;
    • A condition of mental impairment or a developmental disability;
    • A learning disability or a dysfunction in one or more of the processes involved in understanding or using symbols or spoken language;
    • A mental disorder; or
    • An injury or disability for which benefits were claimed or received under the insurance plan established under the Workplace Safety and Insurance Act, 1997.

POLICY

CACC is committed to helping and supporting all its students with a special dedication for students with disabilities, providing them with reasonable, appropriate, effective, and practical means to face all challenges. 

PRINCIPLES

  1. The College will meet its legal obligation to accommodate students with disabilities as reflected in the Canadian Charter of Rights and Freedoms and the Ontario Human Rights Code.
  2. To achieve an optimum academic outcome of Accommodation, the College will promote open communication among students who have personal knowledge of their disability, and the instructor who has content knowledge and an understanding of the required outcomes.
  3. Students are expected to achieve the program’s learning objectives and essential requirements.
  4. Students who self-identify as having a Documented Disability will be provided with information to help them receive support and information on Accommodation at any time.
  5. The primary purpose of academic accommodations is to determine what allowances can equitably be offered to support the learning process while maintaining academic standards.
  6. Students with a Documented Disability and approved Accommodation will have full access to the curriculum, which will assist them in achieving expertise and demonstrating their knowledge in their chosen profession.
  7. An unbiased review of a medical report provided by a qualified professional is an essential first step in determining appropriate Accommodations.

REQUIRED DOCUMENTATION

Students who require Accommodations must provide one of the following documents from a qualified professional:

  • Sensory, Physical, and Medical Disabilities: Documentation of hearing, vision, mobility, and medical disabilities should be completed by the treating physician or a nurse practitioner who is most familiar with a student’s disability. A letter from a doctor or a medical report is acceptable.
  • Mental Health and Psychiatric Disabilities: Documentation of mental health or psychiatric disabilities must be prepared by a Registered Psychologist or Psychological Associate, Psychiatrist, or Physician. The documentation should include a description of the degree of impairment and the rationale for any suggested accommodations. A description of current treatment, such as medication or psychotherapy, and their accommodation implications should also be provided.
    • Please note that documentation of test anxiety in and of itself is insufficient to arrange academic accommodation.
  • Learning Disability: Students with learning disabilities must provide a psycho-educational assessment report completed by a Registered Psychologist or Psychological associate.

PROCESS

  1. Students with a documented disability are encouraged to disclose their disability information prior to their application to CACC or even as soon as the disability has been identified to help the College with adequate time for planning and implementation.
  2. Students must contact the Campus Manager during the enrolment process or as soon as the disability is identified to receive Accommodation for counselling, accessibility, deaf and hard of hearing services, exam accommodations, and assistive devices.
  3. A student with a Documented Disability must complete the Disability Accommodations & Accessible Learning Services form (see appendix I) and provide documentation from a qualified professional to be considered for accommodation. The College may ask for additional medical information if the documented disability is unique and not prominent.
  4. Within two (2) days, the Campus Manager will devise an Accommodation strategy in consultation with the student, and later after obtaining express permission from the student, the instructor. The final determination of Accommodation will be based on specific course objectives, learning outcomes, and available resources. Professional recommendations from external consultation, if any, for Accommodation will be considered.
  5. The Campus Manager will then facilitate the Accommodation implementation the following day.
  6. The student will meet monthly with the Campus Manager and instructor to monitor the effectiveness and outcome of the Accommodation.
  7. Any abuse of an Accommodation will result in discipline or loss of the Accommodation. Examples of abusive actions include sharing notes (in any manner) provided through Accommodation, misusing the right to audio record lectures, using abusive language toward an Accommodation facilitator (including the Campus Manager, instructor, and other staff), or misrepresenting an Accommodation need.

APPEAL PROCESS

Within five (5) College working days, if the student disagrees with the College decision, the student may appeal the decision through the process outlined in Student Grievance, Complaint, Conflict Resolution Policy. Students considering appealing the College decision are encouraged to review the procedures and timeframes detailed in this Policy. In addition, they must complete a Student Complaint/Appeal form available at the Academic Department.

CONFIDENTIALITY

  • The Campus Director will keep all student files confidential. Information regarding a student’s disability can only be disclosed with the express permission of the student unless otherwise requested by Law Enforcement bodies.
  • An instructor will be notified of the student’s disability and Accommodation unless the student chooses to do otherwise. In this case, the student must notify the College in writing, and the College will keep all such information confidential. The teacher will not release information regarding any aspect of the student’s Documented Disability without the approval of the Campus Manager. 

RESPONSIBILITIES

  • The Campus Director is responsible for supporting the College’s vision to provide equal opportunity for students with Documented Disability to succeed in their enrolled programs. The Manager is accountable for actively working with instructors, other staff, and students to ensure the desired outcome from the implemented Accommodation.

  • Instructors are responsible for promoting an inclusive, non-discriminatory free of harassment classroom atmosphere.
    • Instructors will facilitate Accommodations per the plan the Campus Director developed. However, the instructor must notify the Campus Director for a review of the plan if an instructor believes that an Accommodation plan will compromise learning outcomes.
  • Students with a Documented Disability seeking Accommodation are responsible for self-identifying early in their college career. They must follow the processes outlined in this Policy and meet the appropriate academic standards; cooperate with staff, instructors, or Accommodation facilitators; apply for available government funding to offset the Accommodation costs.
  • College Community is responsible for fostering a courteous, inclusive, and respectful environment. By so doing, everyone contributes to the positive learning experience of every student.
    • CACC will provide training and resources to employees and individuals associated with the organization to ensure compliance with this policy.
    • CACC will periodically review and update this policy as necessary to ensure its continued relevance and compliance with applicable laws and regulations.
    • Failure to comply with the policy may result in disciplinary action, in accordance with CACC`s procedures and applicable laws

Failure to comply with the policy may result in disciplinary action in accordance with CACC`s procedures and applicable laws. In case of any disputes, updated printed copies of CACC policies will take precedence over the policies published on our website.
